QUETTA: Nawabzada Ghazain Marri, a former Home Minister of Balochistan, was rearrested in a fresh case by the police once the Division Bench of the Balochistan High Court ordered his release on Tuesday. He was detained under the Maintenance of Public Order Ordinance.

QUETTA:  Nawabzada Ghazain Marri, a former Home Minister of Balochistan, was rearrested in a fresh case by the police once the Division Bench of the Balochistan High Court ordered his release on Tuesday. He was detained under the Maintenance of Public Order Ordinance.

He was arrested after he got bail in all the criminal cases instituted against him and finally detained by District Administration under MPO 3, a preventive law normally used against the political opponents.

Hearing the petition filed by Nawabzada Ghazain against his re-arrest by using preventive laws, the Division Bench of Balochistan High Court comprising on Justice Jamal Mandokhail and Justice Nazeer Langove has released Nawabzada Ghazain Marri. The court declared his preventive detention illegal and ordered his release

Ghazain Marri’s lawyer Arbab Tahir Advocate urged the court that his client had ended his 18 years self-exile to face the case filed against him, “Despite having bail order the Home Department sent Nawabzada Ghazain to prison under Maintenance of Public Order Ordinance,” he told the court.

Acting on his plea the court ordered release order of Ghazain Marri and said Home Secretary had failed to submit his reply in the court.

Additional Deputy Commissioner told the court that the accused was arrested by the direction of Home Department.

“Despite receiving court summon on October 04 the Provincial Home Department is yet to submit their answer and the case won’t be proceed if they don’t submits their answer till next six days.” Justice Jamal Mandokhail said in his remarks.

Ghazain Marri was re-arrested under 3MPO on September 29.

The former Home Minister ended his self exile and returned to the country after 18 long years and on arrival he was taken into custody by the security personnel at the Quetta Airport.

Kohlu Levies registered a case against Ghazain Marri for attacking Levies Station Kohlu while Mr. Marri was also nominated in the assassination of BHC’s judge Justice Nawaz Marri.

Ghazain was confined to the District Prison, Quetta, where the police claimed that he was re-arrested in a fresh case. It is not known that it was an old case or a new case instituted against him. As per tradition police always re-arrest wanted persons in old FIR even there is no mention of his name in the FIR.
